Seller identity & scope

The online store La Maison du Parfum (hereinafter the "Site") is published and operated by the company:

These general terms and conditions of sale (hereinafter "GTC") apply to any order placed by a consumer with full legal capacity via the Site.

These Terms and Conditions govern exclusively online sales made by Niche Distribution LLC under the trading name La Maison du Parfum. They do not apply to sales that may be made in any other context (physical store, marketplace, etc.).

Any order placed on the Site implies full and complete acceptance of these Terms and Conditions, to the exclusion of all other conditions.

Niche Distribution LLC reserves the right to modify these Terms and Conditions at any time. The applicable terms are those in effect at the time the customer confirms the order.

Products

The products offered for sale are those listed on the Site on the day of the order, subject to availability. These mainly consist of perfumes, gift sets, discovery sizes, raw materials, and products related to the world of fragrance.

Product descriptions (olfactory notes, fragrance universe, families, formats, etc.) and visuals are based on information provided by the brands and suppliers. They are updated regularly to accurately reflect reality.

Minor differences may exist between the images and the delivered product (packaging changes, color perception depending on screen, etc.). These differences do not affect the essential characteristics of the product and do not constitute a liability for Niche Distribution LLC.

Some benefits may be offered in the form of gifts, including:

  • samples offered for orders of a minimum amount of €150 including VAT;
  • and, for the purchase of a large format perfume (minimum 50 ml), a free raw material related to the perfume, subject to availability.

These gifts are only offered for baskets that include at least one finished fragrance product . They are not applicable to:

  • orders consisting exclusively of raw materials sold individually;
  • orders consisting exclusively of 2ml formats sold individually.

The samples offered:

  • are offered subject to availability ;
  • can include up to 4 samples per order , regardless of the basket amount;
  • are likely to vary: in case of unavailability, a sample may be replaced by another, chosen by our teams, of equivalent or similar value.

In the case of orders of a particularly large amount, other gifts (for example: goodies, additional formats, etc.) may be added for purely commercial purposes, at the discretion of La Maison du Parfum.

These gifts have no intrinsic market value, cannot be exchanged or refunded and are not contractually guaranteed: they constitute a commercial gesture dependent exclusively on current stock and operations.

Price

The prices displayed on the Site are indicated in euros, inclusive of all taxes (TTC), taking into account the VAT applicable where applicable at the time of the order for the country of delivery concerned.

Niche Distribution LLC reserves the right to change its prices at any time. However, the price charged is the one in effect at the time the customer confirms the order.

Prices do not include delivery charges, which are added and clearly indicated during the ordering process, before final validation.

Promotional offers (codes, discounts, special offers) may be offered from time to time. The terms and conditions of these offers are specified on the Site at the time they are launched.

Unless otherwise stated, the minimum amounts required to benefit from advantages (e.g., free samples, gifts, free delivery, specific benefits) are based on the total amount of the basket after application of promotions and discount codes .
Therefore, if you have a promotional code, the amount of your basket after discount must reach the minimum indicated in order to benefit from the corresponding advantages.

Order

To place an order, the customer must:

  • create a customer account or enter your billing and delivery details,
  • Select the desired products and add them to your cart.
  • check the details of your order (items, quantities, prices, delivery charges, address),
  • accept the terms and conditions of sale / terms of use,
  • Confirm the order and proceed to payment via one of the methods offered.

Final validation of the order constitutes acceptance of the products, prices, associated costs and these Terms and Conditions, and serves as an electronic signature.

An order confirmation is sent by email to the address provided by the customer. This document summarizes the main elements of the order.

Niche Distribution LLC reserves the right to refuse or cancel any order in the following cases:

  • existing dispute relating to a previous order,
  • payment incident
  • suspicion of fraud
  • The order was clearly abnormal in terms of the quantities involved.
  • incomplete or obviously erroneous customer information.

The products remain the property of Niche Distribution LLC until full payment of the price by the customer.

Right of withdrawal

In accordance with the regulations applicable to distance selling to consumers, the customer has a period of 14 days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

For hygiene and safety reasons, only the following products can be returned:

  • Strictly unopened
  • not used
  • in perfect condition
  • in their original, undamaged and sealed packaging.

Any product that has been opened, tested, sprayed, damaged or is no longer suitable for resale will not be eligible for a refund.
Sample sizes (2 ml) , discovery sizes (10 ml) and raw materials cannot be returned.

Products must be returned to the return address provided by customer service, with their original packaging and proof of purchase (invoice or order confirmation).

Unless the error is attributable to Niche Distribution LLC (preparation error, non-compliant product, etc.), the return costs remain the responsibility of the customer.

Subject to compliance with these conditions, the refund for returned products will be made within a reasonable time (generally between 10 and 30 days) from receipt of said products, via the same payment method as that used when ordering, unless otherwise agreed.

Gifts and samples offered as part of the order cannot be refunded or exchanged for cash.

Promotional offers and discounted items

Products sold as part of promotional offers, special operations or discounts benefit from the same legal guarantees as other items.

Unless otherwise specifically stated on the Site, these products remain subject to the right of withdrawal under the same conditions as non-discounted products.

The specific conditions of each operation (dates, limited stocks, non-cumulative, etc.) are indicated on the Site and take precedence over the general provisions in the event of any specific conflict.

The benefits linked to the basket amount (e.g., free samples, gifts, free delivery, specific advantages) are calculated based on the total basket amount after discounts and promotional codes have been applied . If, after discounts, the basket amount falls below the required threshold, the customer will no longer be eligible for these benefits.

Payment methods – Shopify Payments

Payment of the total order amount is due immediately upon validation.

Payments are processed exclusively through Shopify Payments , a secure payment solution integrated into the Shopify platform. Depending on the options offered at checkout, customers can pay by credit card and, where applicable, by other payment methods supported by Shopify Payments.

Transactions are processed in a secure environment: bank details are encrypted and transmitted directly to Shopify Payments. This information is neither accessible nor stored by Niche Distribution LLC.

In the event of a payment authorization refusal or payment incident, Niche Distribution LLC reserves the right to suspend or cancel the order.

Product availability

Product and price offers are valid as long as they are displayed on the Site, within the limits of available stock.

If a product becomes unavailable after order confirmation, Niche Distribution LLC will inform the customer as soon as possible and offer:

  • the refund for the product in question,
  • or, if possible and accepted by the customer, an alternative or an indicative restocking timeframe.

The refund for the unavailable product will be made within a reasonable timeframe and will constitute final settlement.

Gifts (samples, free raw materials, goodies, etc.) are also subject to availability and may be replaced or removed in case of stock shortage, without right to compensation.

Delivery & logistics

Products are delivered to the address provided by the customer when placing the order. It is the customer's responsibility to verify the accuracy and completeness of the information provided (name, address, additional address details, access code, telephone number, etc.).

Order preparation and shipping are handled on behalf of Niche Distribution LLC by Global Horizon Group , which is responsible for logistics and the delivery of goods to partner carriers.

The available delivery methods, indicative delivery times, service areas and associated rates are specified in the Shipping & Delivery section and reiterated at the time of ordering.

The delivery times provided are estimates only, based on information from the carriers. A delay not directly attributable to Niche Distribution LLC or Global Horizon Group shall not, in itself, justify cancellation of the order or the awarding of damages, unless otherwise required by mandatory legal provisions.

In the event of a package that is visibly damaged during delivery, it is the customer's responsibility to:

  • either to refuse the package,
  • either to issue specific and justified reservations on the delivery note,

then report the situation to La Maison du Parfum customer service as soon as possible, providing photos of the package and its contents.

For deliveries outside of France, the order may be subject to customs duties, local taxes or import fees upon arrival of the package in the destination country.

Legal guarantees

The products sold on the Site benefit from the legal guarantees of conformity and against hidden defects, under the conditions provided for by the applicable regulations.

In the event of a defective or non-conforming product, the customer must contact Niche Distribution LLC / La Maison du Parfum within a reasonable time after discovering the defect, describing the situation precisely.

After analysis, Niche Distribution LLC may propose:

  • product replacement (subject to availability),
  • the refund,
  • or any other solution that complies with the legal framework.

In the event of a proven non-conformity for which the seller is responsible, the return shipping costs may be covered.

Responsibility

Niche Distribution LLC cannot be held responsible for:

  • damage resulting from improper use of the products,
  • failure to comply with instructions for use or storage,
  • of any indirect damage related to the use or inability to use a product.

In the context of online sales, Niche Distribution LLC is only bound by an obligation of means. It cannot be held liable for damages resulting from the use of the Internet (data loss, intrusion, viruses, service interruptions, etc.) or from events attributable to a third party or to force majeure.

Intellectual property

All elements present on the Site (texts, images, logos, graphic charter, structure, etc.) are protected by intellectual property rights.

Any reproduction, representation, modification, adaptation, exploitation or use, in whole or in part, of the elements of the Site, by any means whatsoever, without the prior written authorization of Niche Distribution LLC, is strictly prohibited.

Personal data & cookies

Personal data collected via the Site (account creation, order, contact, newsletter registration, etc.) is processed in accordance with applicable data protection regulations.

The methods of data collection, use, storage and the rights of individuals (access, rectification, erasure, objection, portability, limitation) are detailed in the Privacy & Cookies Policy .

Archiving

Niche Distribution LLC archives purchase orders and invoices on a reliable and durable medium, constituting a faithful copy, in accordance with legal requirements.

The customer may request access to documents relating to their own orders, under reasonable conditions.

Dispute resolution

In the event of a dispute, an amicable solution will be sought first between the customer and Niche Distribution LLC / La Maison du Parfum.

In the absence of an amicable agreement, the dispute may be brought before the competent courts, in accordance with the applicable rules of common law.
